When an offshore “contractor” relationship is tested.

A real Fair Work Commission matter that highlights why the structure behind an offshore team matters.

Pascua v Doessel Group Pty Ltd[2025] FWCFB 43 · [2025] FWC 1833

A Philippine-based worker. An Australian business. A question of employment status.

Joanna Pascua lived and worked from the Philippines while performing work for an Australian business. She was engaged under an agreement described as an independent contractor arrangement.

The Fair Work Commission found that she was an employee for the purposes considered by the Commission. On appeal, the Full Bench refused permission to appeal and upheld the finding that there was no sufficient basis to disturb the earlier decision.

In June 2025, the Commission subsequently found Ms Pascua was unfairly dismissed and ordered compensation of A$10,800.

WHAT THE CASE HIGHLIGHTS

Calling someone a “contractor” does not, by itself, determine the legal character of the relationship. The rights and obligations created by the agreement, including matters such as control and whether the person is operating their own business, can matter.

WHAT IT DOES NOT MEAN

This case does not mean every professional working from the Philippines is automatically an employee of an Australian business, or that Australian employment law automatically applies to every offshore arrangement. The facts and applicable law matter.

THE CONTRACTOR QUESTION

Where independent contracting can become more complicated

Independent contracting can be a legitimate model when the person is genuinely operating as a contractor. But for a dedicated, long-term offshore role, businesses should understand the potential downside before choosing the structure.

Classification risk

The label “contractor” is not, by itself, decisive. In Australia, the legal character of the relationship can depend on the contract and, for some businesses, the real substance and practical reality of the relationship.

Entitlements & obligations

Contractors do not have the same rights and entitlements as employees. If an arrangement is later found to be employment, businesses may face questions about unpaid entitlements and other obligations.

Sham contracting risk

It is unlawful to misrepresent an employment relationship as independent contracting where the business does not reasonably believe the worker is a contractor. Penalties can apply.

Less employment infrastructure

A direct contractor arrangement can leave the client responsible for managing contracts, payments, records, onboarding, offboarding and other administration that an EOR can centralise.

Important: Independent contracting is not inherently wrong. The issue is whether the structure accurately reflects the real relationship and complies with the laws that apply to the arrangement.

The practical takeaway: If you are building a long-term offshore team, consider the employment structure before the relationship becomes difficult to unwind.
